What is a Restrictive Covenant?
A Restrictive Covenant is a legally binding agreement that sets specific rules for property use and development within a community to maintain its character and value.

Are there any fees associated with signing?
Yes. The registration fee is $525. This covers all administrative costs related to the research, documentation, and coordination required for the community Restrictive Covenant, managed by legal counsel Joseph M. Shafir. We extend our gratitude to Mr. Shafir for his dedication during town halls and meetings to finalize this project. Mr. Shafir has developed this covenant without a retainer, and the fee includes all legal disbursements. Additionally, many administrative costs—such as direct mail, poster production, printing, and hours spent tracking resident participation—have been generously donated at no additional expense to the community at large. No other ongoing fees beyond the initial $525.
What happens if I don't sign?
Then you are not able to enforce it. Only those that sign can enforce the RC.
Can I take part in the registration after it has been registered with Land Titles?
Yes you can. We would really like to get as many people as possible to sign for the initial registration. So we will keep the initial registration open til end of October.
What percentage of property signatories is required in the neighbourhood for a restrictive covenant to be enforced?
It only takes 2 parties for an RC to be enforceable. However, the more signatories, the better and stronger the enforcement. The more signatories to our covenant the stronger it will be for EVERYONE. So even if your neighbor decides not to sign, don't let that stop you, because in the long run ALL signatories count. Remember once destructive infill takes hold in a community - EVERYONE is affected.
How easy is it to breach a restricted covenant?
Well for our RC, any development on a lot other than a single family dwelling - with a basement suite or a garden suite—would breach the RC.
How can someone legally apply to have a restricted covenant removed?
Yes. They would have to pull title and serve notice to each household notice that signed the RC and try to convince them to remove it for that particular property—so it's next to impossible. Next they would have to apply to the court to have it removed. The court would have to deem removal in the community's best interest. Therefore, the more residents we can get to sign it, the less likely a judge would be inclined to go against the majority of the community's wishes.
Once a property is sold with a restricted covenant, who will manage or enforce it for said property?
It runs with the land.
Are there any additional (annual) fees on top of the $525?
No there is not. It is a one time fee.
